Every piece starts with an idea. Every purchase, with clear terms.

These terms govern the use of theinstinct.es and purchases made through our online store.

1. General information

These terms govern purchases made at theinstinct.es. The identification and contact details of the owner of THE INSTINCT are available in our Legal Notice.

For any questions about your order, you can write to info@theinstinct.es.

2. How to place an order

Select your piece, size and available options, add it to your cart and enter your delivery and payment details. Before completing your purchase, you can review your order and correct any errors.

By confirming your purchase, you accept these terms and the obligation to pay the amount shown. You will receive an order confirmation and summary by email. Keep this message as proof of purchase.

The purchase is concluded in the available language you select during checkout. We retain your order information, and you can request a copy by contacting us.

You must have the legal capacity to enter into a contract and provide accurate information so that we can process your purchase.

3. Pieces and availability

Each product page sets out the piece’s characteristics, composition, sizes and price.

Colours may vary slightly depending on your screen. This does not limit your right to receive a piece that matches its description and advertised characteristics.

If a piece becomes unavailable after you purchase it, we will inform you and refund the relevant amounts without undue delay. Any alternative will require your agreement.

4. Prices and payments

Prices are shown in euros and include applicable taxes. Shipping costs and any additional charges will be displayed before you confirm your purchase.

You can pay using the methods available at checkout. Payment must be successfully authorised for the order to be processed.

We may update catalogue prices. Changes do not affect purchases already made.

5. Preparation and delivery

The usual estimated timeframe is 7–14 working days from payment confirmation, including preparation, shipping and delivery.

If a piece or destination has a different timeframe, we will indicate this before you purchase. If an issue affects delivery, we will inform you and uphold your applicable rights.

6. Returns and withdrawal

If you purchase as a consumer, you generally have 14 calendar days from receipt to notify us that you wish to withdraw from the purchase, without giving a reason.

You can do so by writing to info@theinstinct.es. You will then have a further 14 calendar days to return the piece.

The refund includes the corresponding standard delivery cost and will be made using the same payment method, unless otherwise agreed. We may withhold it until we receive the return or proof that it has been sent, whichever occurs first.

You will only bear the direct cost of returning the goods if you were informed of this before purchasing. Details and the withdrawal form are set out in our Returns and Refunds Policy.

Legal exceptions, such as pieces made to individual specifications or clearly personalised, will be indicated where applicable. Producing a catalogue piece on demand does not in itself remove the right of withdrawal.

7. Statutory guarantee

We are liable for any lack of conformity that becomes apparent within three years of delivery, in accordance with Spanish legislation applicable to new goods.

If you receive a defective piece or one different from what you ordered, write to info@theinstinct.es. We will arrange the remedy required by law, at no cost to you.

8. Website use and intellectual property

You may not use the website for unlawful or fraudulent purposes or in any way that compromises its security.

Designs, photographs, texts, logos and other content belong to THE INSTINCT or their respective owners. Reproduction or exploitation requires authorisation, except for uses permitted by law.

Nothing in these terms excludes any liability imposed on us by law or limits your rights as a consumer.

9. Enquiries and complaints

You can contact us at info@theinstinct.es with any enquiry, issue or complaint relating to your purchase. We will respond as soon as possible and no later than the applicable statutory deadline.

10. Changes and applicable law

We may update these terms. Each order is governed by the version in force when the purchase was made.

Spanish law applies, without depriving you of any mandatory protection you may have as a consumer in your country of habitual residence.

Any dispute will be resolved by the courts with jurisdiction under applicable law.
